Liability
Liability is the legal responsibility for causing an accident. It must generally be established before compensation is considered.
In a road accident claim, liability is worked out from the police report, the sketch plan, witness accounts and any dashcam footage. The question is whose driving fell short of the standard expected. Liability can be shared between both drivers.
Once liability is agreed or proven, the case moves on to quantum, the separate question of what the injury and losses are worth.
When the other side disputes fault, an independent lawyer can argue it for you. Who is at fault explains how liability is usually assessed in Malaysia.
