What Is an Ex Gratia Payment
You were offered a payment described as ex gratia and are not sure what that label actually changes.
An ex gratia payment is money paid as a gesture, without the payer admitting legal liability for the accident. In a Malaysian motor claim, the term most often appears with the Motor Insurers’ Bureau (MIB). The MIB may pay for injury or death caused by an identified but uninsured vehicle.[1]
Where you usually see this term
The MIB calls its payments to victims of uninsured drivers ex gratia, meaning discretionary rather than automatic.[1] An ordinary insurer paying a valid judgment is different, because the law requires that payment.
What ex gratia means for the payment
The payment is no smaller or less real once made. The term means only that the payer is not accepting fault. That matters mainly if the facts are disputed later.
The conditions that usually apply
An MIB payment generally needs the vehicle identified by its plate number.[1] It also needs a police report and a claim brought within three years of the accident. A hit-and-run where the vehicle cannot be traced generally falls outside this remedy.
How this differs from your usual injury claim
An ordinary road accident claim against an insured driver is a legal entitlement, not a discretionary gesture. It sits alongside the wider claim process and does not replace it.
How this compares with an interim payment
An interim payment is an advance on a claim you are already entitled to pursue. An ex gratia payment can be the payer’s final position, made without accepting liability.
What to do if you are offered one
Read what the payment covers, and whether it resolves the whole matter or only part of it. Before you accept a settlement offer covers the checks to run first.
This is the point where an independent lawyer can read the offer, deal with the insurer or the MIB, and take your claim on. For the first contact, share general dates, location, case status and a short summary only. Keep documents private. Only after an identified lawyer or law firm contacts you and specifically asks for them should you provide that identified lawyer or firm with the accident date, where it happened, whether anyone was injured (yes/no), the offer letter and the police report status.

Common questions
Does accepting an ex gratia payment mean I agree the other side was not at fault?
No. The payer does not admit liability by making the payment, and you are not required to agree with that position. Ex gratia is simply the label for a payment made without an admission.
Is an ex gratia payment automatic once I qualify for it?
No. It is discretionary, so it is not an automatic right, even where the usual conditions are met, such as an identified vehicle and a timely claim.
Can I still get an ex gratia payment if the other vehicle was never identified?
Generally no. A hit-and-run where the vehicle cannot be identified at all usually falls outside this remedy in Malaysia. It is better to know this early.
Should I accept the first ex gratia amount offered?
Not before reading what it covers and whether it settles the matter completely. Apply the same care you would to any settlement offer.
