Claim deadlines after a fatal accident
A family member died in a crash and you need to know the deadline to claim.
A family dependency claim must generally start within three years of the date of death.[1] Malaysian courts treat this as an absolute deadline. It is also shorter than the six-year deadline for an ordinary personal injury claim.[2]
Why this deadline is stricter than it sounds
Courts have struck out dependency claims filed even a short time after the three-year mark. The deadline is treated as fixed, and a sympathetic reason does not extend it.
Three years from death, not from the accident
The clock starts on the date of death, not the date of the crash. If the person lived for days or weeks after the crash, the three years count from the later date.
A different period for government vehicles
A different period applies if the at-fault vehicle belonged to the Government or a public authority, such as a police or council vehicle. That claim generally must be brought within thirty-six months.[3] This is close to three years but counted differently, so the dates need checking.
If your family is already close to the deadline
Malaysian courts apply this limit strictly, so waiting until you feel ready carries a real risk once the date is near. This is the point where an independent lawyer can check the dates, prepare the papers and file the claim for your family.
Where to read next
How a dependency claim works explains what the claim involves. Claiming after a fatal road accident sets out how this deadline fits alongside the separate estate claim.
To start, share general dates, location, case status and a short summary only for the first contact. Only after an identified lawyer or law firm contacts you and specifically requests the documents should you provide that identified lawyer or firm with the date of the accident, where it happened, the date of death, and the police report if you have one.

Common questions
Is the deadline three years from the accident or three years from the death?
It runs from the date of death, not the date of the accident. This matters if someone survived the initial crash for a period before passing away, since the clock only starts once death occurs.
Why is the fatal deadline shorter than an ordinary injury claim?
Malaysian law treats a family's dependency claim after a death differently from a living person's own injury claim, which generally has six years in Peninsular Malaysia instead of three. The reasons are historical rather than a reflection of how serious either type of claim is.
We are already close to three years. Is there anything we can do?
It is worth getting advice as soon as possible rather than waiting further, since Malaysian courts have treated this three-year deadline as an absolute bar, with claims struck out even when filed only a short time late.
Does the deadline change if a government vehicle, like a police car, was involved?
Yes, a claim against the Government or a public authority generally must be brought within thirty-six months, a slightly different period worth checking carefully if a government-owned vehicle was involved.
